Overview
This website, embrabody.com, is operated by Marketing and More LLC, a Florida limited liability company ("we", "us", "our"). EMBRA is a brand of Marketing and More LLC. We offer this website, including all information, tools and services on it, to you, the user, on the condition that you accept these Terms of Service ("Terms"), together with the policies linked below.
When you visit our site or buy from us, you agree to these Terms. This includes our Refund Policy, Shipping Policy, 2-Year Limited Warranty and Privacy Policy. If you don't agree, please don't use the site.
Our store is hosted on Shopify Inc. Shopify provides the online e-commerce platform that lets us sell our products to you.
1. Using our store
You must be at least the age of majority in your state to buy from us. You may not use our products or this site for any illegal purpose. You may not send viruses or any harmful code. If you break any of these Terms, we may end your access to the site right away.
2. General conditions
We may refuse service to anyone for any reason at any time. Your content (not including card information) may be sent unencrypted over various networks. Card information is always encrypted during transfer. You agree not to copy, sell or resell any part of the site or our products without our written permission.
3. Accuracy of information
We work hard to keep the information on this site correct and complete. It is provided for general information only. You should not rely on it as the only basis for a decision. We may change the content of the site at any time, but we have no duty to update it.
4. Changes to prices and products
Prices can change without notice. We may change or stop offering a product or part of the site at any time. We are not liable to you or to anyone else for any change in price, pause or end of the service. A price change does not affect orders we have already confirmed.
5. Products
Some products may be available only online and in limited quantities. They can be returned only under our Refund Policy. We try to show colors and images as accurately as possible, but your screen may show colors differently. We may limit sales to any person, region or household. We may limit the quantity of any product we offer.
6. Orders and billing
We may refuse or cancel any order, for example if we suspect fraud or if a price or product description contains an error. If we cancel an order after you have been charged, we refund you in full. You agree to give us current, complete and correct purchase and account information.
7. Health and safety
Customer statements reflect individual experiences; results vary. Our products are not intended to diagnose, treat, cure or prevent any disease. Ask your doctor first if you are pregnant, have light-triggered epilepsy or an active implant. Please read and follow the instructions that come with your product, including the use of the goggles.
8. Third-party tools and links
We may give you access to third-party tools that we don't monitor or control. You use them at your own risk. Links to third-party websites are not under our control, and we are not responsible for their content or for purchases you make there.
9. Your comments and feedback
If you send us ideas, suggestions or reviews, we may use them without restriction and without paying you. You agree that your comments will not break any law or anyone's rights, and will not contain harmful code.

11. Errors and omissions
The site may sometimes contain typing errors, mistakes or missing information about products, prices, promotions, shipping times or availability. We may correct them, and change or cancel orders if information is wrong, at any time, including after you have placed your order.

You may not use the site or its content: for any illegal purpose; to break any law; to infringe our or anyone else's intellectual property; to harass, abuse or discriminate; to submit false information; to upload harmful code; to collect other people's personal information; to spam or phish; or to interfere with the security of the site.

Except for the promises we make in our Refund Policy, Shipping Policy and 2-Year Limited Warranty, the site and our products are provided "as is" and "as available", to the extent the law allows. To the extent the law allows, we are not liable for any indirect, incidental, special or consequential damages that come from your use of the site or our products. Our total liability for any claim about a product will not be more than the price you paid for that product. Some states don't allow these limits, so they may not apply to you.
14. Indemnification
You agree to defend and hold harmless Marketing and More LLC and its owners, employees and partners from any claim made by a third party because you broke these Terms or the law.
15. Severability
If any part of these Terms is found to be unenforceable, that part will be enforced as far as the law allows, and the rest of the Terms stays in effect.
16. Termination
These Terms apply until you or we end them. You can end them at any time by no longer using the site. We may end them if you break them. Your obligations from before the end still apply.
17. Entire agreement
These Terms and the policies linked above are the entire agreement between you and us about the site and your purchases. They replace any earlier agreements.
18. Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law rules. Courts located in Miami-Dade County, Florida have jurisdiction, unless the law of your state gives you the right to bring a claim where you live.
19. Changes to these Terms
We may update these Terms at any time. The current version is always on this page. If you keep using the site after a change, you accept the new Terms.
